 In the late 1990's and onward, Insurers embarked on a new generaton of insurance products covering the litigation spectrum.  Prior to today, ATE was only available in the UK, Canada, Germany, South Africa and a number of other countires that follow common law.  For the past decade there has been a demand  for an ATE policy designed for the traditional American Rule in the USA.  DJF-GG and its affiliates have partnered up with an A+ insurer to now offer ATE or "Fee Shifting" in the USA.

The American Rule states each party bears its own costs of legal expenses including attorney fees.  Courts today have recently begun awarding fees to the other party in certain rulings otherwise known as Fee Shifting.    ATE is a corporate risk management tool to be used amongst other insurance products which limits the exposure to this risk.  Our product was designed to respond to situations where judges or a jury awards attorney fees to the other party.  We believe this will be a game changer in litigation today.
